1. General Terms and Acceptance of Agreement

These Terms and Conditions, along with our Privacy Policy and Refund Policy, form a legal agreement between you or the individual or entity accessing or using our services ("User," "You," "Your"), and StreamGenZ, the operator of the website streamgenz.com ("StreamGenZ," "We," "Us," "Our," "the Platform"). This Agreement governs your access to and use of the Platform, including any functionality, and services offered on streamgenz.com.

By creating an account, accessing, or otherwise using any part of the Platform or its services, you represent that you have read, understood, and categorically agree to be bound by all terms and conditions contained within this Agreement. If you do not agree to any of these terms and conditions, you must not access or use the Platform.

Important: StreamGenZ reserves the right, at its sole and absolute discretion, to revise, amend, or modify this Agreement at any time and for any reason, with or without prior notice to you. All changes are effective immediately when we post them and apply to all subsequent access to and use of the Platform.

2. Definitions

For the purposes of this Agreement, the following terms shall have the meanings ascribed to them below:

Account

Refers to the unique user account established by a User on the StreamGenZ Platform to access our services.

Agreement

Refers to these Terms and Conditions, the Privacy Policy, the Refund Policy, and any other rules or policies posted on the Platform.

Confidential Information

Encompasses all non-public information disclosed by StreamGenZ to the User, including login credentials and communications.

Platform

Refers to the website streamgenz.com, its subdomains, and all associated software, applications, and services.

Primary Service Provider

The original third-party company or entity that creates, owns, and offers the underlying digital subscription service.

Subscription Slot

The specific, limited, and temporary right granted by StreamGenZ to access and use a shared premium account of a Primary Service Provider.

3. Nature of the Service and Acknowledgment of Risk

This section outlines the fundamental nature of the Service provided by StreamGenZ and requires your explicit acknowledgment and acceptance of the inherent risks associated with its use.

3.1. Disclaimer of Affiliation

IMPORTANT DISCLAIMER: STREAMGENZ IS AN INDEPENDENT, THIRD-PARTY PLATFORM. WE ARE NOT AFFILIATED WITH, ASSOCIATED WITH, AUTHORIZED BY, ENDORSED BY, SPONSORED BY, OR IN ANY WAY OFFICIALLY CONNECTED WITH ANY PRIMARY SERVICE PROVIDER. ALL PRODUCT AND COMPANY NAMES, LOGOS, TRADEMARKS, AND COPYRIGHTS ARE THE PROPERTY OF THEIR RESPECTIVE OWNERS.

3.2. Service Description

The Service provided by StreamGenZ consists of facilitating shared access to premium subscription accounts offered by Primary Service Providers. Our role is to manage the technical and logistical aspects of this sharing arrangement to provide a stable experience for our community of Users.

4. Account Registration and Security

The following terms govern the creation and maintenance of your Account.

To create an Account and use the Service, you must:

Be at least 18 years of age or the age of legal majority in your jurisdiction, whichever is greater
Possess the legal authority to enter into this binding Agreement
Reside in a jurisdiction where access to and use of the Service is not prohibited by law

You agree to provide true, accurate, current, and complete information about yourself as prompted by the Platform's registration form. You further agree to maintain and promptly update this information to keep it true, accurate, current, and complete.

If you provide any information that is untrue, inaccurate, not current, or incomplete, StreamGenZ has the right to suspend or terminate your Account.

Unless StreamGenZ explicitly agrees, each individual is strictly limited to one (1) User Account. You shall not create an Account on behalf of another person or create an Account for the purposes of impersonation, fraud, or abuse of the Platform's policies.

The discovery of multiple accounts held by a single individual will result in the immediate suspension or termination of all associated accounts.

You are solely and entirely responsible for maintaining the confidentiality and security of your StreamGenZ Account username and password. You agree to:

Not disclose your password to any third party
Take full responsibility for all actions performed through your Account
Immediately notify StreamGenZ in writing of any unauthorized use of your Account

5. User Conduct and Acceptable Use Policy

Your use of any Subscription Slot is subject to a strict set of rules designed to ensure the stability, security, and usability of the shared account for all participating Users. Failure to adhere to these rules constitutes a material breach of this Agreement and will result in severe penalties, including immediate termination of your service without refund.

5.1. Absolute Prohibitions

Critical Violations

Modify Credentials: Attempt to change, reset, or request a change for login credentials
Alter Billing Information: Access or modify billing information or payment methods
Interfere with Profiles: Create, delete, or rename profiles on the shared account

Sharing Violations

Share Access: Share, sell, rent, or lease login credentials to any other person
Multiple Devices: Use the Subscription Slot on more than one device simultaneously
Profile Misuse: Use profiles other than the one assigned to you

5.2. Usage Limitations and Responsibilities

Device Limitation

You shall only log in to and use the Subscription Slot on a maximum of one (1) device at any given time. Concurrent streaming on multiple devices is strictly forbidden.

Assigned Profile Usage

You must exclusively use the profile that has been assigned to you by StreamGenZ (e.g., "Profile 3," "User 3").

Respectful Conduct

You shall not engage in any activity that interferes with or disrupts the viewing experience of other Users.

Consequences: Violation of these rules constitutes a material breach and will result in immediate termination of your service without refund.

6. Financial Terms: Orders, Payments, and Renewals

This section governs all financial transactions conducted on the Platform. By making a purchase, you agree to these financial terms.

6.1. Orders

All orders on the Platform are considered final upon submission. Once an order is received and processed, it is non-cancellable and non-refundable, except under the highly limited circumstances outlined in our Refund Policy (Section 7). StreamGenZ reserves the right to reject any order for any reason prior to processing.

6.2. Pricing and Payment

Pricing

All prices are listed in United States Dollars (USD) unless otherwise specified. Prices are subject to change at any time without prior notice.

Payment Processing

All payments are processed through a secure third-party payment processor. You agree to provide a valid payment method and authorize us to charge it for your purchases.

Taxes and Fees

You are responsible for any applicable taxes, which are not included in the listed prices. By providing payment information, you warrant that you are authorized to use the designated payment method.

7. Cancellation and Refund Policy

This policy defines the terms, conditions, and limited circumstances under which a refund may be issued. It is designed to be strict to protect the Platform's operational model and prevent abuse.

7.1. General Policy: All Sales Are Final

Important: As a general and overriding rule, all purchases made on StreamGenZ are final, and all payments are non-refundable. The digital, time-sensitive nature of our Service necessitates this strict policy.

7.2. Limited Exception for Total Service Failure

A partial or full pro-rata refund may be considered by StreamGenZ, only in the event of a complete and verifiable failure of a purchased Subscription Slot for a continuous period exceeding seventy-two (72) hours. To be eligible for consideration:

The failure must be a total inability to access the service
The failure must be directly attributable to an error by StreamGenZ
The User must have reported the issue promptly and cooperated with troubleshooting

7.3. Exclusions from Refund Eligibility

User-Related Issues

Suspension due to Agreement violations
Failure to cancel renewal before billing
Change of mind or accidental purchase

Service-Related Issues

Dissatisfaction with Primary Service Provider content
Minor or temporary technical issues
Temporary downtime or brief interruptions

8. Intellectual Property Rights

This section addresses the ownership and use of intellectual property related to both the StreamGenZ Platform and the services of the Primary Service Providers.

8.1. Primary Service Provider IP

You acknowledge and agree that all right, title, and interest in and to the services offered by the Primary Service Providers, including their software, content libraries, trademarks, service marks, trade names, logos, and all other intellectual property, are and shall remain the exclusive property of the respective Primary Service Providers or their licensors.

8.2. StreamGenZ IP

The StreamGenZ Platform, including its website design, text, graphics, software, source code, selection and arrangement thereof, and all other material and content on the Platform, are the exclusive property of StreamGenZ and are protected by international copyright, trademark, and other intellectual property laws.

8.3. User Content

If you submit any content to the Platform (e.g., reviews), you grant StreamGenZ a worldwide, non-exclusive, royalty-free, perpetual, and irrevocable license to use, reproduce, modify, adapt, publish, and display such content in connection with the operation and promotion of the Service.

9. Disclaimers of Warranties and Service Guarantees

This section limits our legal obligations regarding the quality and reliability of the Service. It is essential for managing User expectations and mitigating liability in a high-risk operational environment.

9.1. "AS IS" and "AS AVAILABLE" Basis

IMPORTANT DISCLAIMER: YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT YOUR USE OF THE PLATFORM AND ANY SUBSCRIPTION SLOT IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. STREAMGENZ AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

10.1. Exclusion of Certain Damages

LIABILITY LIMITATION: TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU EXPRESSLY UNDERSTAND AND AGREE THAT STREAMGENZ, ITS DIRECTORS, OFFICERS, EMPLOYEES, PARTNERS, AND AGENTS SHALL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES.

Maximum Liability

In any event, our total liability to you will not exceed the amount you have paid to us or USD $25 of a disputed StreamGenZ service, whichever is less.

11. Indemnification

You agree to defend, indemnify, and hold harmless StreamGenZ, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Platform.

Scope of Indemnification

This indemnification obligation includes, but is not limited to, claims arising from:

Your breach of any representation, warranty, or covenant in this Agreement
Your violation of any applicable law or regulation
Your infringement of any third-party rights
Your misuse of the Platform or any Subscription Slot
